Lawsuit filed against multiple parties after tragic spa fatality

Californians are known for spending time outside in the warm, sunny weather. And with that lifestyle comes a lot of outdoor features and amenities at people's homes. For instance, there are over a million pools and spas across the state.

While pools and spas can help people cool off and relax, they can also present a serious safety hazard if they are not properly built, maintained and protected. One boy's death was a tragic reminder of the devastating consequences that can be suffered when this does not happen.

The fatal accident occurred when the boy and his family rented out a California home equipped with a spa. One evening, the boy was swimming in the spa and went under water. His arm got stuck in the suction of the spa pump and he could not free himself. By the time his family was able to get him out, he had passed away.

The family recently filed a lawsuit against numerous parties, including the home owner, the rental company and the makers of the pump that had been installed in the spa.

According to their suit, the family maintains that their loss was attributed to the fact that the pump did not have a safety vacuum release system and that there was not an adequate cover on the spa drain. Had either of these elements been in place, it is possible that the entrapment would have been avoided.

This situation is a devastating reminder that accidents can and do happen in pools and spas when they do not have proper safety features in place. Numerous laws and regulations exist that specify which features must be in place to keep people safe, but property owners may not always comply with these specifications.

In the event of an accident in or around someone's pool or spa, it can be wise for victims and/or their families to pursue the legal remedies available. Money and lawsuits cannot undo the damage that has been done, particularly in the event of a fatality, but these things can provide critical support for those who have suffered physical, emotional and financial damage.
