Homeowner liability for Airbnb rentals

California homeowners may enjoy the convenience of renting out their homes through Airbnb. However, it is important for people to understand when they may be liable for injuries a renter incurs in their home.

Many people who rent out their homes may not have home insurance which covers renters. According to the National Law Review, homeowners typically need extra insurance if they will rent out their home for any sort of business purpose. People may not always be liable for injuries if they do not carry insurance which covers renters. In these circumstances, people may think that Airbnb is liable for any injuries someone sustains in a home. This is not always the case, though. Airbnb is typically considered to be liable if a home was not accurately described on the website and this misrepresentation lead to a renter’s injury. They may also be at fault if they did not identify any possible hazards at a house.  

Homeowners may be considered liable for a renter’s injuries if parts of their home are not well-lit or if the floors are slippery. People are usually responsible for ensuring that their house is safe, and they may be required to pay damages to a renter if they did not point out places where people should watch their footing or if known hazards were not fixed.

While homeowners may be reluctant to participate in house-sharing programs because of liability concerns, they may have more protection than they realize. says that Airbnb typically offers insurance for the homeowners who rent through the company. This usually covers any damage a renter may cause, as well as any injuries which are incurred. This insurance is intended to cover homes when homeowners do not have the insurance which would cover renters.
